TERMS OF SERVICE — INGE
Last updated: 16 september 2026
OVERVIEW
Welcome to INGE! The terms "we", "us" and "our" refer to INGE, operated by INGE DESIGN S.R.L., registered office at Drumul Cheile Turzii 125-135, 042096, Romania, sole registration code 50163713.
INGE operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). INGE is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as your right of withdrawal, the legal guarantee of conformity, warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.
Nothing in these Terms limits or excludes any right you have under mandatory consumer protection legislation of the European Union or of the Member State in which you are habitually resident. Where any provision of these Terms conflicts with such mandatory rules, the mandatory rules prevail.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or that you have otherwise attained full legal capacity under the law of your country of residence, and that you have given us your consent to allow any minors in your care to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your e-mail address and your billing, payment and shipping details. You represent and warrant that all information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for the activity carried out through your account, except where such activity is not attributable to you. You may not transfer, sell, assign or license your account to any other person.
SECTION 2 — OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online store, in accordance with our obligations on pre-contractual information and fair commercial practices under Directive 2011/83/EU and Directive 2005/29/EC, as transposed into Romanian law. However, please note that colours or product appearance may differ from how they appear on your screen due to the type of device you use to access the store and to your device settings and configuration. Such minor differences in display do not in themselves constitute a lack of conformity.
All descriptions of products may be changed at any time. Changes do not affect orders already confirmed by us. We reserve the right to discontinue any product at any time and may limit the quantities of any product we offer to any person, geographic region or jurisdiction, on a case-by-case basis, provided that any such limitation is applied on a non-discriminatory basis and in compliance with Regulation (EU) 2018/302 on unjustified geo-blocking.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. Before you complete your order, we will clearly display the main characteristics of the products, the total price including taxes, delivery costs and any additional charges, and you will be asked to confirm that you accept the obligation to pay.
Your order is accepted when we send you an order confirmation by e-mail, which constitutes the conclusion of the contract. We may decline an order for objectively justified reasons, including unavailability of the product, an obvious pricing or description error, failure of payment, or a reasonable suspicion of fraud or of resale contrary to these Terms. If we do not accept, change or cancel an order, we will notify you without undue delay using the e-mail address, billing address and/or telephone number provided at the time the order was made, and we will refund any amount already paid.
Please review your order carefully before submitting it. A request to cancel or amend an order after confirmation is subject to whether the order has already been dispatched; this does not affect your right of withdrawal under Section 6.
Returns and exchanges are governed by Section 6, Section 7 and our Refund Policy [LINK].
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.
SECTION 4 — PRICES AND BILLING
Prices displayed to consumers include value added tax (VAT). Delivery, handling and any other additional charges are displayed separately before you complete your order and are included in the total amount payable shown at checkout.
Prices, discounts and promotions may change at any time, but the price charged will be the price in effect at the time your order is placed, as set out in your order confirmation e-mail. Where a reduced price is announced, we indicate the prior price in accordance with Directive 98/6/EC as amended by Directive (EU) 2019/2161.
For deliveries outside the European Union, customs duties or import charges may apply and are payable by you; these are not included in the displayed price and we will indicate this before you place your order.
SECTION 5 — SHIPPING AND DELIVERY
Unless we agree another delivery period with you, we will deliver the products without undue delay and in any event no later than 30 days from the conclusion of the contract, in accordance with Article 18 of Directive 2011/83/EU.
If we fail to deliver within that period, you may ask us to deliver within an additional period appropriate to the circumstances. If we fail to deliver within that additional period, you are entitled to terminate the contract and we will refund all sums paid without undue delay. Where delivery within the agreed period is essential, or you have informed us that a specific date is essential, you may terminate the contract immediately upon expiry of the delivery period.
Delivery time estimates shown in the store are indicative. We will inform you without undue delay of any delay caused by the carrier, by customs processing or by circumstances beyond our reasonable control, and your rights set out above are not affected.
Risk of loss of or damage to the products passes to you only when you, or a third party designated by you other than the carrier, acquire physical possession of the products. Where you commissioned the carrier yourself and that carrier was not offered by us, risk passes on handover to that carrier.
SECTION 6 — RIGHT OF WITHDRAWAL (CONSUMERS)
If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU and Government Emergency Ordinance no. 34/2014.
Withdrawal period. The period expires 14 days from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods. Where the order comprises multiple goods delivered separately, the period runs from receipt of the last item; for goods consisting of multiple lots or pieces, from receipt of the last lot or piece.
How to withdraw. Inform us of your decision by an unequivocal statement — for example by e-mail to [EMAIL] or by post to [ADDRESS] — before the period expires. You may, but are not required to, use the model withdrawal form set out in Annex I(B) to Directive 2011/83/EU. It is sufficient that you send your statement before the deadline.
Returning the goods. You must send the goods back without undue delay and in any event no later than 14 days from the day you communicate your withdrawal. You bear the direct cost of returning the goods, unless we have stated otherwise or have failed to inform you of this cost.
Refund. We will reimburse all payments received from you, including the costs of standard delivery, without undue delay and no later than 14 days from the day we are informed of your decision to withdraw. We will use the same means of payment you used for the original transaction, unless you expressly agree otherwise, and you will incur no fees as a result. Where you chose a delivery method more expensive than our standard offering, we reimburse only the cost of standard delivery. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them, whichever is earlier.
Diminished value. You are liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
Exceptions. The right of withdrawal does not apply to the categories listed in Article 16 of Directive 2011/83/EU, including goods made to your specifications or clearly personalised, sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery, and goods which are liable to deteriorate or expire rapidly. We identify any such products in the store before you order.
SECTION 7 — LEGAL GUARANTEE OF CONFORMITY
We are liable to you for any lack of conformity of the goods existing at the time of delivery and becoming apparent within two years of that delivery, in accordance with Directive (EU) 2019/771 and Government Emergency Ordinance no. 140/2021.
Where goods are not in conformity, you are entitled — free of charge — to have them brought into conformity by repair or replacement, or to receive a proportionate price reduction or to terminate the contract, in the order and under the conditions provided by the applicable legislation. Any lack of conformity which becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless proven otherwise or unless that presumption is incompatible with the nature of the goods or of the lack of conformity.
Any commercial guarantee we or a manufacturer may offer is additional to, and does not restrict, these statutory rights.
To make a claim, contact us at [EMAIL] with your order number and a description of the issue.
SECTION 8 — INTELLECTUAL PROPERTY
Our Services, including but not limited to all trade marks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement thereof, are owned by INGE, its affiliates or its licensors and are protected by European Union and Romanian intellectual property law, including Regulation (EU) 2017/1001 on the European Union trade mark, Directive 2001/29/EC, Directive (EU) 2019/790, Directive 96/9/EC and Law no. 8/1996 on copyright and related rights, as well as by the applicable international conventions.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Services without our prior written consent, except where such use is expressly permitted by a mandatory exception or limitation under European Union or Romanian copyright law. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting you a licence or other rights under any patent, trade mark, copyright or other intellectual property right of INGE, Shopify or any third party. All rights not expressly granted herein are reserved by INGE.
INGE's names, logos, product and service names, designs and slogans are trade marks of INGE or of its affiliates or licensors. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trade marks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trade marks of their respective owners.
SECTION 9 — OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor control and to which we make no input.
We provide access to such tools "as is" and "as available", without any warranty, representation or condition of any kind and without endorsement. Any use by you of the optional tools offered through the site is at your own discretion, and you should familiarise yourself with and satisfy yourself as to the terms on which those tools are provided by the relevant third-party provider(s). Our liability in relation to such tools is limited to the extent permitted by Section 16 and by applicable law.
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.
SECTION 10 — THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including embedded third-party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third-party sites, you do so at your own risk.
Subject to Section 16 and to applicable law, we are not liable for harm or damage related to your access of third-party websites, or to your purchase or use of products, services, resources or content on third-party websites. Please review the third party's policies and practices carefully and make sure you understand them before you enter into any transaction. Complaints, claims, concerns or questions regarding third-party products and services should be directed to the third party.
SECTION 11 — PRIVACY AND DATA PROTECTION
All personal data we collect through the Services is processed in accordance with Regulation (EU) 2016/679 (GDPR) and our Privacy Policy [LINK], which sets out the purposes and legal bases of processing, the recipients of the data, retention periods, any transfers outside the European Economic Area and the safeguards applied to them, and how to exercise your rights of access, rectification, erasure, restriction, data portability, objection and withdrawal of consent, as well as your right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP) or with the supervisory authority of your habitual residence.
Because the Services are hosted by Shopify, Shopify processes personal data relating to your access to and use of the Services on our behalf as a processor, under a data processing agreement concluded in accordance with Article 28 GDPR. Information you submit through the Services may be transmitted to Shopify and to other recipients which may be located outside your country of residence; any transfer outside the European Economic Area is carried out on the basis of an adequacy decision or of appropriate safeguards under Chapter V GDPR. Please review our Privacy Policy for further details.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any such errors, inaccuracies or omissions and to update information at any time without prior notice.
Where an obvious error affects an order you have already placed — in particular a manifestly incorrect price — we may cancel the order and refund you in full, and we will inform you without undue delay. This does not affect contracts already validly concluded where no obvious error is involved, nor your rights under Sections 6 and 7.
SECTION 13 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any applicable European Union, national or local law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, slander, disparage or intimidate any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any unsolicited advertising or promotional material, including "junk mail", "chain letters" or "spam"; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm INGE, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or any other malicious code that may affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal data of others; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraping, data gathering or extraction tool, automatic device or process, AI tool (such as agentic AI) or automated or manual means to access the Services, except as expressly permitted by mandatory provisions of European Union or Romanian law; or (f) interfere with, bypass or circumvent the security or authorisation features, robot exclusion headers or other measures we employ to restrict access to the Services.
Where we find that you have materially breached this Section, we may suspend, restrict or terminate your access to the Services. We will inform you of the measure and of the reasons for it, and you may contest it by contacting us at [EMAIL], unless informing you is prohibited by law.
SECTION 14 — TERMINATION
You may close your account and stop using the Services at any time.
We may suspend or terminate your access to the Services (or any part of them) where you have materially breached these Terms, where required by law, or for another objectively justified reason. We will give you reasonable prior notice and a statement of reasons, except where immediate action is necessary to prevent unlawful activity, security incidents or harm to us or to other users, or where notice is prohibited by law.
Termination does not affect any order already accepted, your right of withdrawal under Section 6, your rights under the legal guarantee of conformity in Section 7, or any amount due up to the date of termination.
The following sections continue to apply after termination: Intellectual Property, Right of Withdrawal, Legal Guarantee of Conformity, Termination, Disclaimer of Warranties, Limitation of Liability, Severability, Waiver and Entire Agreement, Governing Law and Dispute Resolution, Privacy and Data Protection, and any other provision which by its nature should survive termination.
SECTION 15 — DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made available for general information purposes, except for pre-contractual information which we are required to provide under Directive 2011/83/EU and which forms part of the contract. We do not warrant the accuracy, completeness or usefulness of general informational content, and any reliance you place on it is at your own risk.
To the extent permitted by applicable law, and without prejudice to Sections 6 and 7, the Services are provided "as is" and "as available". We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.
Nothing in this Section excludes or limits the legal guarantee of conformity, the pre-contractual information obligations, or any other statutory right you have as a consumer under European Union or Romanian law.
SECTION 16 — LIMITATION OF LIABILITY
We are liable for damage caused to you by our failure to perform our obligations under these Terms, in accordance with applicable law.
To the extent permitted by applicable law, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of savings, loss of data or loss of business opportunity, where such loss was not foreseeable at the time the contract was concluded.
The following are not excluded or limited in any way: liability for death or personal injury; liability arising from intent or gross negligence; liability under the legal guarantee of conformity (Section 7) and the right of withdrawal (Section 6); liability under Directive 85/374/EEC on liability for defective products, as transposed into Romanian law; liability under Regulation (EU) 2016/679; and any other liability which may not be excluded or limited under mandatory European Union or Romanian law.
SECTION 17 — SEVERABILITY
If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable part shall be deemed severed from these Terms of Service. Such a finding does not affect the validity and enforceability of the remaining provisions. Where a provision is found to be unfair within the meaning of Directive 93/13/EEC, it shall not be binding on you, while the remainder of the contract continues to bind the parties if it is capable of continuing without the unfair term.
SECTION 18 — WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms of Service does not constitute a waiver of that right or provision.
These Terms of Service and any policies or operating rules we post on this site or in respect of the Services constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, including any prior versions of the Terms of Service. This does not exclude any pre-contractual information we are required to provide, which forms an integral part of the contract, nor any specific commitment we have made to you in writing.
In accordance with Article 5 of Directive 93/13/EEC, where there is doubt about the meaning of a term, the interpretation most favourable to the consumer prevails.
SECTION 19 — GOVERNING LAW AND DISPUTE RESOLUTION
These Terms of Service and any separate agreement under which we provide you the Services are governed by Romanian law and by the applicable law of the European Union.
If you are a consumer habitually resident in another Member State of the European Union, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence, in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I).
Courts. Proceedings we bring against you as a consumer may be brought only in the courts of the Member State in which you are domiciled. You may bring proceedings against us either in the Romanian courts having jurisdiction at our registered office or in the courts of the place where you are domiciled, in accordance with Articles 17 to 19 of Regulation (EU) No 1215/2012 (Brussels I bis).
Complaints. Please contact us first at [EMAIL]; we will acknowledge your complaint and respond without undue delay.
Alternative dispute resolution. If we cannot resolve your complaint, you may refer the dispute to an alternative dispute resolution entity, in accordance with Directive 2013/11/EU and Government Ordinance no. 38/2015 — in Romania, the SAL structures within the National Authority for Consumer Protection (ANPC) or another authorised ADR entity. You may also submit a complaint to ANPC (anpc.ro). Recourse to ADR is voluntary and does not affect your right to bring court proceedings.
SECTION 20 — CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page.
We may update, change or replace part of these Terms of Service, for example to reflect changes in the law, in our Services or in our business practices. We will notify you of any material change by a durable means, such as e-mail or a prominent notice in the store, at least [30] days before the change takes effect, together with the date on which it takes effect and your right to reject the change by closing your account before that date. Changes do not apply retroactively to orders already confirmed.
Your continued use of or access to the Services after a change takes effect constitutes acceptance of that change.
